In this sense, patent law is a special form of the law that protects property and is peculiarly effective in any society where private property is recognized. In today’s world, technological advance is probably the single most significant factor pervading economics, political, and social. It can be appreciated, therefore, that the law that deals with the rational handling of this type of property is of fundamental importance to all. Obtaining a patent is initiated by the filing of a non-provisional patent application in the United States Patent & Trademark Office. The application includes a complete description of the invention, claims defining, which are analogous to the description of land defining the property rights in a deed to real estate. A drawing in each instance where the nature of the invention requires explication by a drawing, an oath or declaration which, among other things specifies that the applicant is the original inventor. All of these must comply with various statutory requirements and with rules established by the United States Patent & Trademark Office pursuant to the patent statute. The application must be made by the inventor with the papers signed and verified by the inventor, unless the inventor is dead, unavailable, or mentally incompetent. Legal representatives of dead inventors and of inventors under some legal incapacity may make application for a patent for satisfaction of the requirements and on the same terms and conditions applicable to the inventor.

A limitation in 35 U.S.C. § 171, however, is that the design must be “Ornamental.” Design patents protect against infringing appearance, rather than function. “Ornamental design” means that the patentable subject matter is limited to the visual characteristics which an object displays. Designs can exist on two different visual levels that are often interrelated: (1) surface ornamentation applied to an article of manufacture without regard to its shape, e. g., a line drawing applied to a coffee cup; and (2) the shape of the article, e.g., the ornate shape of a coffee cup beyond that required to define an upright vessel with a handle,

An application is abandoned by failure to take appropriate action within the specified time or if it is decided that a patent is to be granted, the applicant is sent a Notice of Allowance and if the issue fee, due within three months, is paid, the patent is granted.
